"No person shall, in trade, engage in conduct that is misleading or deceptive or is likely to mislead or deceive". You can mislead or deceive inadvertently, and still be caught. It is common in those standard terms to place qualifications or limitations on the liability you are prepared to accept or the remedies available to the customer if something goes wrong. However if that customer is a consumer and the sale is covered by the Consumer Guarantees Act, they will have a range of remedies set out in that Act that you cannot contract out of. If you tell that customer in your standard terms and conditions of trade that they have only a limited range of remedies against you, that can be misleading and deceptive because depending on the limitations, it will usually be untrue.
